ZYDA LAW secure their third win against against Basingstoke and Deane Borough Council's continuing refusal to grant planning permission for smaller household residential development.

By decision letter dated 10 June 2008, the Planning Inspector, Mr David Hogger allowed an appeal against Basingstoke and Deane Borough Council's refusal to grant planning permission for the sub division of a three bedroomed family dwelling into two no. one bed flats.

The Basingstoke and Deane Borough Council has adopted a policy stance that is opposed to sub division of 'family' dwellings and this appeal is one of twenty one that has been lodged against the Council.

ZYDA LAW disagreed with the Council's single reason for refusal and demonstrated to the satisfaction of the Inspector that a strong local need exists for small households, suitable for single and elderly people, and that the development proposed would make a positive contribution to the provision of mixed communities in keeping with Government policy as expressed in PPS3 Housing and the Green Paper. 

The Inspector found in favour of the developer and granted planning permission subject to conditions.
