Zyda Law's appeal successes continue. Having recently secured planning permission for a developer client (on appeal) for six residential developments in Basingstoke & Deane, together with partial and full costs awards from the notoriously conservative Planning Inspectorate!
Basingstoke & Deane Borough Council have used every trick in the book to attempt to block the client's proposals but have so far been foiled by Zyda Law. The costs awards were an additional, hefty blow for the Council, forcing them to retreat from their current position and, to re-examine their own Development Plan policies! The permissions and awards have been followed by a serious complaint which is expected to be escalated to the Local Government Ombudsman.
In light of evidence produced at the Hearings, Zyda Law has assisted the client in preparing for future applications by advising on the materials needed to support an application including a policy appraisal and a Design and Access Statement. Prevention being better than cure!
The client has more applications in the pipeline to which more resistance is expected – Zyda Law will be in the frontline in appealing refusals.
