ZYDA LAW SECURES LEAVE FOR JUDICIAL REVIEW

Following a recent hearing Zyda Law LLP has obtained the consent of the High Court to judicially review the decision of a Government appointed Inspector in refusing to grant planning permission for a residential development.
The decision of the Planning Inspectorate requires the client (in compliance with an Enforcement Notice issued by the Local Planning Authority) to demolish a house built outside of permitted dimensions. Zyda Law advised the client to challenge the decision, and instructed Queen's Counsel to prepare a skeleton argument and attend the hearing at the Royal Courts of Justice in London.
The success is notable, judicial review not being a legal challenge regularly granted leave, and reinforces Zyda Law's formidable reputation as an expert in the UK's planning system.
Zyda Law will now prepare for the substantive hearing where a Judge will decide if the Inspector's decision should be quashed and remitted to the Inspectorate for reconsideration.
