COMPULSORY PURCHASE
Public bodies (such as Local Planning Authorities) may exercise their powers under compulsory purchase legislation to acquire land for various purposes. Anyone affected can expect to be compensated for losses suffered.
The courts apply a presumption in favour of the landowner in that they are entitled to adequate compensation and, that a public body will not be entitled to acquire the land without payment, a principle now enshrined in European law (European Convention on Human Rights).
